European Parliament elections
Elections to the European Parliament take place in all Member States of the European Union. The election resulted in 705 elected representatives representing interests at EU level. Slovenia has 8 members in the European Parliament. The number of Members of the European Parliament depends on the population of each EU Member State and on the provisions of the European Treaties.
The European Parliament is the only body that is formed directly - through elections. With the Act on the Election of Deputies from the Republic of Slovenia to the European Parliament (ZVPEP, Official Gazette of the Republic of Slovenia, No. 40/04 - official consolidated text, 41/07 - ZVRK, 109/09, 9/14 and 59/17) the right, the electoral system, candidacy, voting and the outcome of elections.
Elections of deputies from the Republic of Slovenia to the European Parliament are called by the President of the Republic. The act on the call for elections is published in the Official Gazette of the Republic of Slovenia (Article 3 of the ZVPEP).
Members of the Republic of Slovenia to the European Parliament are elected directly on the basis of universal suffrage by secret ballot for a term of five years.
The electoral system is proportional to preferential voting - the personalization of elections, with voters having the opportunity to influence the choice of candidates and not just the choice of political parties.
The Republic of Slovenia as a whole represents one constituency (Article 11 of the ZVPEP).
The division of seats takes place at the level of the whole country, where seats are allocated to lists of candidates according to the d'Hont system. Due to the established preferential voting, the mandates are not divided in the order indicated on the candidate list, but the candidates who received the highest number of preferential votes are elected from each list, and these are taken into account only if the number of preferential votes exceeds the quotient. , which is calculated by dividing the number of all votes cast for the list by twice the number of candidates on the list (Article 13 of the ZVPEP).
Slovenian citizens have the right to vote, who have the right to elect a member of the National Assembly (the age of majority of the voter, the voter is entered in the register of voting rights, the voter is not deprived of the right to vote). The right to vote of Slovenian citizens is equal to the right to vote of citizens of EU member states.
Under the same conditions as Slovenian citizens, citizens of EU Member States who have permanent or temporary residence in the Republic of Slovenia (on the last day when it is still possible to submit candidacies) have the right to vote, if it has not been revoked. Foreign citizens are subject to the general condition that they be entered in the electoral register. The voting rights of citizens of the Republic of Slovenia and foreign citizens of other Member States are completely equal and include both active and passive suffrage, so citizens of other Member States enjoy the right to vote under the same conditions as Slovenian citizens (Article 10 ZVPEP).
The electoral process is not significantly different from the elections to the National Assembly. The same applies to candidacy, with only eight deputies being elected, who can be nominated by political parties and voters. Regarding the organization and work at polling stations, voting and determining the result of voting, the provisions of the National Assembly Elections Act (ZVDZ, Uradni list RS, No. 109/06 - official consolidated text, 54/07 - US decision, 23/17) shall apply mutatis mutandis. and 29/21), unless otherwise provided by the ZVPEP.
Parliamentary mandates are shared by the National Electoral Commission because Slovenia is a single constituency for these elections. Confirmation of a Member's mandate takes place within the country and also in the European Parliament. The National Assembly confirms the election of deputies in the same way as the mandates of its deputies. After the verification, the President of the National Assembly informs the President of the European Parliament of the outcome of the elections. The European Parliament must be informed of any change in the situation, including the possible termination of a Member's term of office.
Protection of the right to vote
An appeal against the decision of the National Assembly may be lodged with the Constitutional Court of the Republic of Slovenia. The National Electoral Commission takes care of the legality of elections, coordinates the work of electoral commissions of constituencies and district electoral commissions, and performs other tasks in accordance with the National Assembly Elections Act.
