EU law – general
EU law consists of:
- primary legislation of the EU:
- secondary legislation of the EU:
- EU case law:
Legislation of the EU has the power of supranational force (of course only for EU member states), which means that the legislation of an EU Member State must be in line with EU law. The European Commission monitors the implementation and application of EU law in the Member States. The Government Office for Legislation of the Republic of Slovenia is responsible for coordinating responses to European Commission writings, and the Ministry for timely preparation of responses to alleged violations (acknowledgment of violation, denial of violation, silence) for those areas for which they are competent and responsible.
If the European Commission finds violations of the acquis in the proceedings, the Member State must take appropriate measures in a timely manner to remedy the alleged violations, otherwise the European Commission may submit a request to the Court of Justice for a declaratory judgment, which, in accordance with Article 260 of the Treaty on the Functioning of the European Union, may include paymet of a lump sum or fine.
